Throughout the site, the terms “we”, “us” and “our” refer to BetrayedOnes. The following terms and conditions (hereinafter referred to as “Terms”) govern the access and use of betrayedones.io website, as well as any other media channels, forms or applications. It also governs the receipt of the non-fungible tokens – “NFTs” (here referred as “Services”). By visiting or using this site you engage and accept all of our terms, conditions and policies on behalf of yourself or any entity you represent. You further warrant that you are fully capable and competent to enter the site. The Site is intended for users who are at least 18 years of age. Person under this age limit are not permitted to use or register for the site. If you do not agree to all the terms, you may not access or use the site or use any services. The site and NFTs are copyrighted works of the BetrayedOnes.

[GENERAL]
You agree not to reproduce, duplicate, copy or exploit any portion of the service, use of the service or access to the service or any contact on the website through which the service is provided, without express written permission by us. 

Access to, and rights to display and use the metadata associated with an NFT are governed by a separate “user license” that must be affirmatively acknowledged prior to receiving an NFT. 

Additional terms and conditions, as well as documents can be shared on the site from time to time. We reserve the right to make any changes for any reasons at any time. You can always check for any update of the “Last updated” date of these terms. It is your responsibility to periodically check the terms and stay informed of updates.

It is not inteded that NFTs may be purchased and/or distributed to any person or entity in a jurisdiction or country where such distribution or use is contrary to law and regulations or which would subject us to any registration requirements within such a jurisdiction or country.

[INTANGIBLE PROPERTY]
The NFTs which are available on the site are digital assets created by us and deployed through the use of smart contracts on the Ethereum Blockchain (here referred to as “Chain”). NFTs are owned by controlling the private key associated with the public address on the chain (“wallet”). The NFTs will continue to exist as long as the the Chain exist (or they have been moved to another blockchain network).  Which also means that the NFTs are beyond the control of any party, including us. In addition the metadata (images, designs, 3D renders, text, taglines, traits, video or audio and other) will be separately maintained by us or our subcontractors.

[NFT PURCHASE]
In order to participate in the release and purchase process, you must register on the site. The registration may require you to sign up with a valid E-Mail address and through our premint link, in order to be allocated a whitelist spot. NFTs will be initially sold on our site via one or more modified auction processes using certain digital assets as payment. You agree to abide and follow all rules and regulations for each auction (“mint”). Any payments or other transactions (inclduing transfer of NFTs to other wallets) will be conducted through the Chain or through a third-party service providers. We have no control over these payments/transactions, and we do not have the ability to reverse any payments/transactions. Transactions and payments through third-party providers will be subject to separate terms and conditions. We have no liability to you or any third-party for any claims or damages that may arise through any payments or transactions that you engage via our site or any other third-party and Chain.

To purchase NFTs on our site, you have to use a supported third-party wallet (such as MetaMask) in order to facilitate the purchase and storage of NFTs. The NFTs may also be traded and sold over a secondary marketplace, Those transactions will be subject to the terms and conditions of such marketplaces.

Every transaction on the Chain requires the payment of a transaction fee, payable in the native digital asset of the used Blockchain Network.

[ASSUMPTION OF RISK]
By using this site and service you acknowledge that there are risks associated with this serivce and especially all blockchain-based assets, including NFTs (things such as; volatility in price, lack of liquidity, risk of loss due to hardware/software or internet connections and/or failures, the risk of malicious software, the risk of third-parties obtaining unauthorized access to your wallet, and the riks of loss due to loss of your private key, and transaction erros).  We will not be responsible for any of these risks. We do not have any warranties, promises or guarantees. Also changes of the underlying Blockchain Network, such as upgrades, forks or feature change, which may have negative impact to our services are not in our hands, and thus not our responsibility.

[DISCLAIMER]
The site and NFTs and any associated metadata are provided “as is” and “as available”. You acknowledge and agree that your use of the platform, NFTs, metadata and our service is at your own risk. We will not be liable for any failure to perform our obligations under these terms to the extent caused by an event that is beyond our reasonable control.
